CANCELLATION POLICY:
• Cancellation More Than 30 Days Before Charter Period: A service fee of $100 will be forfeited if the charterer cancels the agreement with at least 30 days' notice in writing received by the booking agent.
• Cancellation Less Than 30 Days Before Charter Period: If less than 30 days' notice of cancellation is given, the full charter fee shall remain due and payable.
• Exceptional Circumstances: The full charter fee will only be waived or refunded if the operator is able to obtain an alternative booking for the same charter period.
TERM & RENT:
The charter period and fee are agreed upon. A deposit is due upon signing, and the balance must be paid at least 30 days before the charter begins.
DEPARTURE:
The vessel is provided in proper condition at Keppel Bay Marina. The charterer must examine the vessel before departure. If the operator can't deliver within 24 hours, the charterer may cancel. The charterer is responsible unless a sailing guide is requested, in which case, additional fees apply.
CHARTERER'S AUTHORITY FOR CREW:
The charterer gains full authority over the vessel and crew. If a sailing guide is required, the guide has the authority on safe navigation. The charterer agrees to obey reasonable orders and sail to safe destinations.
LIMITATION OF USE:
The vessel's use is restricted to specific hours and areas. It should be for pleasure only, following all laws. The charterer must not exceed the specified party number or carry restricted items.
LIMITATION OF LIABILITY:
The operator is not liable for property loss, personal injuries, or indirect damages. The charterer can claim under the Trade Practices Act 1974, if applicable.
INSURANCE:
The vessel and charterer are insured. The operator may deduct excess from the security bond.
ACCIDENT:
Immediate notice of accidents is required. No admissions of liability should be made, and repairs need operator authorization.
SECURITY BOND:
A $500 security bond is required before possession. Deductions may occur for damages or excess cleaning costs.
INVENTORY & RETURN:
The vessel is delivered with topped-up tanks. The charterer must maintain and return the vessel in good condition. A Certificate of Inventory is signed upon return.
