BOOKING & PAYMENT POLICY:
• A 50% deposit is required upon confirmation of your agreed booking details.
• Once booked and the deposit is paid, the cost of your booking is generally not subject to change.
• The balance of the booking price must be settled at least 60 days before the departure date.
• Payments should be made via bank transfer or automated payment upon receiving the booking invoice.
GENERAL TERMS & CONDITIONS:
• Rates on the website may not always be correct due to seasonal and other changes.
• Changes to booking arrangements must be requested in writing and signed by the Party Leader.
• Any modifications to menu choices, catering plans, or additional guest numbers must be submitted at least five days before the booking date.
• Clients are responsible for the proper conduct of themselves and their party.
• We reserve the right to terminate the booking of any client whose behavior poses a risk or annoyance.
• Termination results in the cessation of our responsibility, and extra costs incurred are the client's liability.
• Clients must replace or repair any damages caused by their party to us or affiliated third-party suppliers.
• The skipper or operator is responsible for the vessel's safe navigation, and guests must abide by their decisions.
• Use of illegal substances during the booking leads to instant termination, forfeiture of payment, and potential legal action.
• Clients and their party must be aware of the risks associated with charter activities.
• Full insurance covering injuries is strongly recommended before engaging in any charter activities.
• We are not liable for indirect or consequential losses incurred by clients in relation to their booking.
• Consumer Guarantees Act 1993 and Fair-Trading Act 1986 are excluded from the contract for business-related bookings.
• The vessel's course is at the sole discretion of the captain/operator, complying with Maritime Law and local regulations.
• We hold our own Liquor Licenses, and intoxicated persons may be refused service or removed from the event as deemed necessary.
CANCELLATION POLICY:
Cancellation charges are as follows:
• 60+ days: 10% of any monies paid
• 30-59 days: 20% of total booking cost
• 15 - 29 days: 50% of total booking cost
• 14 days or less: 100% of total booking cost, plus catering deposit (if applicable) if canceled after supplies purchase (usually 48-60 hours).
For "Other Events," all deposits and amounts paid are non-refundable if you elect to cancel. Refunds possible under the following circumstances:
• Written agreement for a refundable deposit
• Clause 5 applies, and we decide to offer a refund
• Unfit vessel for booking (mechanical breakdown, natural disaster, etc.)
• Postponement by us not caused by you.
Changes or Cancellations by Us:
We reserve the right to make changes or cancel due to circumstances beyond our control. If we cancel and no fault on your part:
• Accept replacement booking (subject to availability and rate variation)
• Accept a reasonable refund offer (deemed full and final settlement of claims).
Neither party is liable for default due to unforeseeable circumstances. If canceled by us due to weather, a 'Rain Check' is offered, subject to availability.
