PAYMENT:
The Charterer is obliged to make the down payment amounting 50% of the total amount within 7 days upon signing the accommodation agreement. The remaining amount of 50% he is obliged to pay 5 weeks before agreed accommodation.
All payments must be made five weeks prior to the scheduled accommodation. The cost includes the use of the vessel and insurance. The payment can be made using a local currency account in kunas or a foreign currency account in EUR. The costs of the charterer's bank must be covered. The Charterer will promptly receive the bank account information.
COMMITMENTS:
We deliver the boat to the charterer with the water and fuel tanks fully stocked, clean, and in good operating order. The charterer is required to complete the check-in process with the customer in accordance with the inventory list. The Charterer has the right to request a reimbursement for the days he was unable to utilize the vessel if we are unable to deliver it at the prearranged location and time. He must insure to the Charterer another vessel with the same or similar features if we are unable to deliver the vessel within 24 hours of the agreed-upon date.
Any concealed flaws in the boat's construction or equipment that we were unaware of at the time of delivery to the charterer, as well as any flaws that develop later on, preclude any request to reduce the rental cost. If a piece of equipment that was lost or broken during a prior charter cannot be provided in time for the departure, there is no cause for complaint as long as the absence of the item does not compromise the safety of the navigation.
INSURANCE:
All marine risks are covered by vessel insurance, which also includes required insurance for third parties. According to the terms of the insurance policy, any damage that occurred during the rental time but wasn't immediately notified to our firm will not be accepted. In this situation, the Charterer is liable for all damage because he failed to inform us or failed to do so in a timely manner. It is advised to obtain separate insurance because the skipper's and the crew members' personal belongings are not covered by the boat's insurance.
CHECK IN / OUT:
Check-in on Saturdays begins at 17.00, and check-out is at 9.00 on Saturdays. The boat must be returned by the charterer no later than 18:00 hours on the evening of the charter's conclusion (Friday); overnight stays are permitted until 9:00 hours on the following day (Saturday).
DEPOSIT:
The charterer must leave the security deposit as specified in the charter agreement prior to receiving the vessel. The credit card used for the deposit must be used. The charterer's deposit will be applied to any damage to the vessel that is equal to the franchise amount.
CANCELLATION:
If for some reason the charterer is unable to take possession of the ship, he can find another customer who is prepared to stay aboard the ship for the predetermined time. If the charterer is unable to locate a replacement customer, we shall charge the charterer as follows:
• 5% within 7 days of booking confirmation
• 10% within 30 days of booking confirmation
• 30% of the total amount for cancellations 30 days after booking confirmation or 60 days before the accommodation period
• 100% of the total amount for cancellation less than 30 days before the accommodation period
COMPLAINTS:
Only written complaints that are signed by the person in charge on behalf of our company and received upon vessel return will be considered. The allowed remuneration cannot exceed the cost of the rental.
ARBITRAGE:
The Split Tribunal's authority is being established in cases of disputes that cannot be settled amicably.
Damage Deposit is fully refunded to you in 72 hours of your checkout, subject to any breakage/damage claims by the Operator/Owner.
