• Until one month before the charter's start date, a 50% cancellation fee will apply.
• Until two months before the charter's start date, a 30% cancellation fee will apply.
In cases of objective reasons such as a death in the family, serious injury, war, COVID-19 restrictions, etc., leading to charter cancellation:
• The already paid amount will not be refunded.
• The owner may offer the charterer the vessel during a free period or in the next season as an alternative arrangement.
TAKE OVER THE YACHT:
• The owner provides fully equipped yachts with full fuel tanks and in excellent sailing condition. The charterer is expected to return the yacht in the same condition.
• In the event that the owner cannot provide the booked yacht as agreed, they must offer at least an identical yacht as a replacement. If providing an identical yacht is not possible:
a) The owner covers demurrage charges.
b) The owner must arrange suitable accommodation during the demurrage period.
c) If there is no takeover within the next 24 hours, the charterer has the option to cancel the yacht charter and receive a full refund of all payments to the owner.
• Upon taking over the yacht, the charterer must carefully inspect its condition and equipment according to the inventory list. Covered defects that were not known to the owner at the time of takeover or defects that arise afterward do not entitle the charterer to a reduction in the charter price.
• If the charterer encounters circumstances that make further cruising impossible or if disembarkation is unavoidably delayed, they must inform the base manager for further instructions. The charterer is responsible for any charges incurred by the owner due to delays caused by adverse weather conditions. Therefore, planning the route and returning in the evening on the day before check-out is recommended for a smooth charter experience.
INSURANCE:
• The yacht is insured for third-party damages and force majeure incidents, up to its registered value.
• The charterer must get owner approval for non-chargeable repairs during the cruise.
• Significant damages, including those involving other boats, must be reported to the harbor-master's office for insurance purposes.
• Failure to meet obligations may lead to full responsibility for damage costs.
• Sails and engine damages due to oil lack are not covered by insurance; daily oil checks are mandatory.
• Personal belongings and crew safety are the charterer's responsibility; it's recommended to take precautions.
CHARTERER’S OBLIGATIONS:
• Charterers must sail within Croatian territorial waters, except with a written permit.
• Sub-chartering or transferring the yacht to others is not allowed.
• Nighttime sailing in unsafe weather conditions and violations of public rules, orders, & laws are prohibited.
• The number of persons on board must match the crew list.
• Charterer or skipper must possess a valid license for open-sea navigation and a UKW-radio certificate.
