PRICES INCLUDED:
Skipper’s fee, Fuel, Drinking water, Ice for the cooler, Use of all the equipment on the boat
CHARTER AND PAYMENT:
• The Charter Company facilitates the Vessel for the Charter Period upon payment of the Charter Fee by the Charterer.
• An Advance Payment is required as a deposit to secure the Vessel, paid upon signing. The Balance Payment, Damage Deposit Waiver Insurance, and Security Deposit are due before the Charter Period begins.
• Boat delivery conditions include passport copies, balance payment, and signing of the vessel's inventory and condition.
SECURITY DEPOSIT:
• The Security Deposit may be applied by the Charter Company to cover damages or liabilities.
• In cases of gross negligence, Security Deposit retention doesn't affect the Charter Company's right to recover outstanding liabilities.
• The Security Deposit or balance is returned within 2 days of Redelivery or upon dispute resolution.
SKIPPER RESPONSIBILITY AND RIGHTS:
• The skipper is appointed by the Charter Company and is responsible for vessel management, navigation, and safety.
• The skipper's authority prevails in case of safety concerns.
• The skipper checks in/out the Vessel, ensures safety, and guides passengers.
• The skipper's responsibilities include navigation, mooring, safety, and limited hours of service.
OPTIONAL HIRING OF A HOSTESS:
• Upon request, the Charter Company can provide a hostess for provisioning, cooking, cleaning, and assisting the skipper.
CHARTER COMPANY OBLIGATIONS:
• The Charter Company delivers the Vessel in seaworthy condition with full tanks of fuel and water.
• Delivery delays may result in a pro-rata return of the Charter Fee.
• The Charter Company is not liable for delays due to Force Majeure events.
INSURANCE AND LIABILITIES:
• The Vessel is insured, and the Charterer indemnifies the Charter Company for damages not covered by insurance.
• The Charter Company is not liable for death or injury unless due to negligence.
• The Charterer must report incidents promptly.
CHARTERER OBLIGATIONS:
• The Charterer agrees to the Skipper's judgment and adheres to cruising limits.
• The Charterer is responsible for running expenses, adhering to rules, and limiting the party size.
• The Vessel must be redelivered in good condition, and the Charterer shall follow safety instructions.
AGREEMENT OF CANCELLATION:
• Cancellation terms vary with the timing of the cancellation, ranging from full refund to forfeiture of fees.
• The Charterer may receive a refund if the trip is canceled due to specific circumstances.
• The Charter Company can terminate the agreement for Charterer non-compliance.
GENERAL TERMS:
• The Agreement governs the rights and obligations of the parties.
• The Agreement is subject to Grenada's laws, and disputes may undergo mediation or court proceedings.
• If any provision is void, the remaining terms remain valid.
