RESERVATION AND PAYMENT:• Charter Reservation - Clients can reserve the Charter Vessel for the Charter Period via our Website, email, telephone, fax, or in person at our offices. Written confirmation from our company is required to confirm the booking.
• Advance Payment - An Advance Payment is due within 7 days of reservation.Payment can be made through our website or wire transfer to our bank account. 50% Advanced payment or full payment of the Charter Fee is required.
• Payment Balance - If an Advance Payment of 50% is made, the remaining Charter Fee balance is due no later than 45 calendar days before the Charter Start Date.
• Check-in - Clients can check in on the Charter Vessel after all Obligatory Payments are settled.
• Short Notice Charters - If a charter begins in less than 45 days and the Vessel is available, a 100% Charter Fee payment is required for reservation confirmation.
• Charter Prices - Charter prices are listed in Euros on our current price lists and include VAT.
• Charter Inclusions - The Charter includes a technically sound and clean vessel with full fuel and water tanks. Ready-to-use equipment on board, insurance, anchorage in the Home Marina for the first and last days, and a sailing permit are provided.
• Additional Costs:
1. Clients are responsible for additional costs, including:
2.All fuel costs for the Charter Vessel
3.All watersports equipment
4.All marina fees, pilot and skippers’ fees, water, electricity
5.National and/or local taxes, food and beverages, personal laundry, and other amenities costs
6.All harbor and other entry fees in other marinas, and other necessities such as car parking and crew health insurance.
CHANGES OR CANCELLATION OF THE CHARTER:• If you wish to change the Charter Period or cancel your reservation, please send a written request via email, fax, or through the contact form on our website.
• Any changes or cancellations are confirmed only upon our written email confirmation.
• Cancellation made up to 45 days before Charter Start Date: 50% of the Charter Fee (advance payment).
• Cancellation made within 45 days before Charter Start Date: 100% of the Charter Fee.
• Cancellation after check-in or during the Charter Period: 100% of the Charter Fee plus expenses incurred due to the cancellation.
• Change of Charter Period dates: Additional 15% of Charter Fee (if Vessel available).
• Change of check-in/check-out time within the same Charter Period: No compensation, no return of proportional Charter Fee.
• Prolonging Charter Period after Start Date: Charged according to daily charter fee, subject to availability.
• If you need to cancel due to objective reasons (serious illness, etc.), we can arrange changes of dates for the Charter as per terms.
• If you choose to end the Charter before the scheduled end, no proportional Charter Fee return is available.
FORCE MAJEURE:The Charter Operator is not liable for damages or losses due to events beyond our control, including war, riot, strikes, terrorism, sanitary issues, natural disasters, government interventions, or flight cancellations.
• In case of force majeure, payments made for the Charter will be credited for a future booking; no refunds will be issued.
• We will collaborate with you to arrange a new Charter on an available Vessel, location, or dates based on your preference.
• Agreed new Charter payments remain as credit, valid up to 2 years from booking, deducting from future Charter cost.
• Additional expenses resulting from force majeure-related changes are not our responsibility.
DAMAGE DEPOSIT:A refundable damage deposit must be submitted (specified in the booking confirmation) in cash or via credit card during check-in. The deposit is fully refundable upon satisfactory check-out if no damages are detected on the Charter Vessel.
• Any subsequent incidents may lead to additional damage deposits.
• Additional damage deposits might be required for new losses or damages during the Charter.
• Inform us within 24 hours of any damage or loss to the Charter Vessel.
• You are responsible for repairing any damage occurring during your responsibility after check-in.
• Gain approval from us before repairing, ensuring technical suitability.
• If damage or equipment loss occurs, the deposit covers transaction fees up to the damage cost; the balance is returned.
• Unfilled fuel tanks upon return will incur deductions for fuel and refilling from the deposit.
INSURANCE:Our company ensures the Charter Vessel and its equipment in accordance with Cyprus law, covering fire, marine and collision risks, third-party damage, and all loss or damage.
• As a result, you are relieved of liability covered by the insurance, unless proven to be caused by gross negligence or default on your part.
• We do not hold responsibility for loss or damage to personal property or injuries to you or anyone aboard with your permission.
• If your gross negligence causes Vessel loss or damage, you are liable for full repair costs.
CHECK-IN:Our company agrees to outfit and deliver the Charter Vessel to you, without crew, clean, equipped with bed linen and towels, ready for sea, and in proper running and seaworthy condition.
• The Charter Vessel will be delivered to you at the start of the Charter Period as agreed. Time for familiarization is part of the Charter Period.
• Upon check-in, you must carefully inspect the Charter Vessel and its equipment, confirming their condition with the provided check-in list.
• We will provide the Charter Vessel under these conditions:
1.Full payment and damage deposit from you.
2.Both Parties sign a delivery statement (inventory) specifying conditions.
3.Copy of your sailing license and identification card.
4.Copy of your passport.
5.List of charter's crew members with names and addresses.
• If the Charter Vessel is not provided to you, you are entitled to a refund for the unavailable days.
• In such a case, we have the right to offer a replacement Charter Vessel of equal or better standard.
• If we fail to provide a replacement, you can terminate the agreement and claim a refund.
• If we fail to provide a replacement during check-in, you can terminate the agreement and claim a refund. We may also offer a new Charter for a new period, with agreed changes.
RETURN THE CHARTER VESSEL:The Client agrees:
• To return the Charter Vessel to us at the designated port or marina stated in the Contract or Invoice, disposing of waste and personal belongings properly.
• To return the Charter Vessel, its equipment, and all belongings in the same condition as at check-in, on the agreed date, time, and place.
• In case of loss or damage hindering return, or if unable to return on time, the Client shall pay demurrage as specified.
• To inform us if returning the Charter Vessel becomes delayed during the Charter Period.
• If leaving the Charter Vessel at a different location, the Client agrees to cover expenses for transfer and any resulting damages.
• For intentional delay or change of itinerary, the Client agrees to pay a prorated charter fee plus 50%.
• If the delay exceeds twenty-four hours, the Client is liable for any losses incurred by us due to the delay.
CLIENT’S RESPONSIBILITY:• All expenses for marinas, water, fuels, and repairs resulting from improper use of the Charter Vessel.
• Mooring fee for Limassol Marina on non-first and non-last charter days.
• Ensuring the Charter Vessel's proper use, navigation, and compliance with safety measures.
• Preventing the need for towing; immediate notification and following instructions if towing is necessary.
• Not sailing in prohibited conditions or areas, following navigation charts, and staying within Cyprus territorial waters.
• Not sailing at night without our prior consent.
• Avoiding illegal activities that may lead to Charter Vessel confiscation.
• Recording and reporting any damages or accidents to us and obtaining necessary certifications.
• Daily engine oil level checks; covering costs for engine damage due to oil deficiency.
THE CLIENT AGREES NOT TO:The Client agrees not to:
• Hand over the Charter Vessel to a third party.
• Use the Charter Vessel for commercial transportation of people or goods.
• Exceed the confirmed crew list and responsibilities.
• Ensure crew members' safety and keep necessary documents on board.
• Participate in regattas without our written consent.
• Operate the boat under the influence of alcohol or drugs.
• Bring pets on board without our prior approval.
• Enter specified restricted areas, including Northern Cyprus and certain beaches.
Damage Deposit is fully refunded to you in 72 hours of your checkout, subject to any breakage/damage claims by the Operator/Owner.
