PAYMENT CONDITIONS:
Only after the regular payment has been made (50% at the time of booking, the remainder 4 weeks prior to the start of the rental) are the chartered yachts with full equipment usable.
CONDITIONS OF CANCELLATION:
If the charterer decides to terminate the agreement for whatever reason, he or she may, with the owner's prior approval, transfer his or her rights and obligations to another person. If he or she fails, the costs of cancellation will be covered by the advance payment, and:
• 50% of the charter price for cancellation up to 1 month before commencement of the charter.
• 100% of the charter price for cancellation within the last month before commencement of the charter.
TAKEOVER OF YACHT
• Yachts are fully equipped and fueled, expected to be returned in the same condition.
• Yachts available 5 p.m. to 9 p.m., if not taken within 48 hours, the contract may be canceled.
• If the owner can't provide a yacht within 24 hrs after term, the charterer can cancel for refund.
• Charterer checks the yacht's condition, defects not known to owner don't reduce price.
• In case of cruise issues or delays, inform the base manager for instructions.
• Charges for delays due to bad weather are on charterers.
• Return yacht by evening before check-out day, exceptions with owner's agreement.
• Owner may refuse the yacht if the charterer lacks competence or disregards instructions.
CAUTION MONEY:
• Caution money (security deposit) required upon yacht takeover, refunded fully for timely return in good condition.
• Deposit needed even with skipper. Any damage or equipment loss due to negligence charged to the charterer.
INSURANCE:
• Yacht insured against third-party damages and force majeure up to insured value.
• Owner/manager approval needed for cruise-related damage repairs.
• Charterers must report major incidents to authorities and insurance.
• Damages to sails, engine due to lack of oil not covered.
• Personal belongings not insured; crew covered.
CHARTERER’S OBLIGATIONS:
• Charterers must sail within Croatian territorial waters, seek permission to leave.
• No sub chartering, night sailing in unsafe weather, or breaking laws.
• Crew list occupancy enforced; charterer responsible for non-compliance.
• Charterer/skipper must possess valid navigation skills and licenses.
• Immediate damage reporting to owner; owner must repair within 24 hrs.
• Notify owner and authorities for missing yacht, equipment, or navigation issues.
• Failure to comply holds the charterer responsible for consequences.
COMPLAINTS:
Only written complaints, signed by both parties on the occasion of return of the yacht will be taken into consideration.
ARBITRATION:
All the possible disagreements or disputes that cannot be settled peacefully, will be under the jurisdiction of the owner’s court in Zagreb.
