PRICES:
• High Season: 3 Hour - $1,443, 4 Hour - $1,829, 6 Hour - $2,312, 8 Hour - $2,737
• Low Season: 3 Hour - $1,300, 4 Hour - $1,426, 6 Hour - $1,852, 8 Hour - $2,392
BOOKING:
A Charter will be confirmed upon receipt of the deposit specified in the quotation and signed acceptance of these Terms and Conditions. Bookings made within 14 days of the Charter date require full payment at the time of booking.
DEPOSIT:
The deposit is 50% of the boat Charter fee unless otherwise specified. New Year's Eve bookings for private charters require an initial 25% deposit at booking, with progress payments and the final 50% due by the last day of November.
PAYMENT:
Final payment and guest numbers are due 14 days before the Charter unless agreed otherwise. The final guest numbers specified by the Charterer 14 days prior will be deemed the minimum for catering charges. Guest numbers may increase with approval but not decrease.
CANCELLATION:
More than 60 days prior: Refundable deposit, less a $500 management fee if rebooked.
Between 60-28 days prior: Non-refundable deposit.
28–14 days prior: Total payment non-refundable.
Less than 14 days prior: Full payment non-refundable.
GENERAL TERMS & CONDITIONS:
• Methods of Payment: EFT, cash, or credit card. Credit card surcharges may apply.
• Additional Charges: Any additional charges on the day are immediately charged to the provided credit card.
• Responsible Service of Alcohol: The Operator abides by the NSW Liquor Act, refusing service to intoxicated persons and those under 18. Indecent behavior leads to charter termination with no refund.
• Bond: The Charterer lodges a security bond specified in the quotation, released 7 days after the Charter.
• Substitute Vessel: In case of breakdowns, the Agent may provide a similar vessel; Any Boat is not liable for cancellations due to circumstances beyond control.
• Request To Change Boats: Changing boats treats the original reservation as canceled, incurring a cancellation fee.
• Weather Conditions: Charters proceed regardless of weather unless the Master deems it unsafe. Postponements must be completed within six months.
• Charter Course: The Master decides the course for safety, welfare, and good order.
• Embarkation and Disembarkation: The Vessel docks at confirmed times. Excess time incurs charges.
• Responsibility of the Charterer: The Charterer is responsible for the group's conduct, acknowledging and conveying these Terms and Conditions.
• Damage to Vessel: The Charterer is liable for any loss or damage caused by the group.
• Limit of Liability: Operator liability is limited per the Limitation of Liabilities and Maritime Claims Act 1989 (Cth).
• Indemnity: The Charterer indemnifies the Operator against losses caused by negligent acts.
• Regulatory Compliance: Customer requests breaching vessel restrictions are declined.
• Risk Warning: Passengers participate at their own risk, with no responsibility accepted for injury or damage.
• Swimming: Permitted during daylight hours when stationary, subject to crew discretion.
• Decorations: Limited decorations are allowed, with guidelines provided.
• Jurisdiction: New South Wales laws govern this agreement.
• Acceptance: Acceptance of the quotation binds the Charterer to these Terms and Conditions.
• Charterer Property: Any items left behind must be collected within 2 business days, with no liability for loss or damage.
