CHARTER FEE & PAYMENT:
The charter fee includes yacht dues for its usage during the period of time stated in the contract. It does not include petrol expenses, tourist and residence taxes and berth costs outside the domicile marina. The chartered yacht with complete equipment can be used only after the payment is credited to the charteree's account: - 50% of the charter fee the last 5 days upon signing the contract - 50% of the charter fee the last 4 weeks before commencement of the charter. If payments are not made by the due dates, the chartereree reserves the right to cancel the contract/reservation and to charter the yacht to a third party.
DEPOSIT:
Upon taking ownership of the vessel, the Charterer must pay the security deposit in cash or by credit card at the starting marina. If there is no damage or fault discovered when the yacht is returned, the deposit will be fully repaid. In the event that the equipment, specific yacht components, or the boat itself is lost or damaged, the chartereR is entitled to keep the amount equal to the cost of repairing, buying, and/or purchasing the lost or damaged equipment or specific yacht components. The Charterer has the right to retain the sum corresponding to the loss of profit in the event that the induced damage makes it impossible for the yacht to be further hired.
CHARTEREE OBLIGATION:
The Charteree must be able to supply the Charterer with a clean and dry yacht in seaworthy condition, with a full fuel tank and water tanks, at the agreed-upon time and location. If the Charteree fails to meet these terms, the Charterer may request a money refund for the days he did not use the yacht. If the Charteree is unable to provide the yacht at the agreed location within 24 hours of the time period for takeover, or if another yacht is not available, the Charterer has the right to withdraw from the contract and demand a refund of the total charter fee for the number of days he did not have the yacht at his disposal.
In the event of damage or defect to the yacht or its equipment caused by regular boat usage, the Charterer is required to notify the Charteree immediately, and the Charteree is required to remove the damage upon notification. If the Charteree does not remove the damage within 24 hours, the Charterer has no right to seek reimbursement.
CHARTERER’S OBLIGATION:
The Charterer is responsible for all daily berth expenses at ports or marinas, fuel prices, oil, water, cleaning, and any other essentials, as well as repairing or replacing any damages or faults that occur while the yacht is in the Charterer's care. The Charterer is also responsible for adhering to customs and other regulations and norms, caring for the boat and its equipment, and navigating it with care and following the standards and practices of a good navigator.
The Charterer is also responsible for not subletting the yacht to a third party, participating in regattas or yacht races, using the yacht for commercial purposes, professional or night fishing, and sailing at night in inclement weather. The Charterer is also responsible for keeping a log book, monitoring the engine oil level on a daily basis, and maintaining the sails.
INSURANCE:
The conditions stated by the insurance company with whom the yacht is insured govern the insurance. The yacht is protected against third-party damage. Damages covered by insurance that are not reported quickly to either the Charteree or the insurance company will not be recognized under the insurance policy. In that instance, the charterer is personally liable for the overall damages as a result of failing to notify the damages. Insurance covers all franchise damages due by weather or other natural disasters, but not intentional damages. Charges for intentional damages are not restricted by deposit. The charterer is obligated to reimburse all expenses incurred as a result of intentional damage. Insurance does not cover damage to the sails or the engine caused by a low oil level in the motor. The charges for these damages are paid for by the charterer.
CANCELLATION:
If the charterer is unable to begin the charter for any reason, the charterer may locate another individual to take his place as a charterer (with the charteree's prior acceptance). If the charterer is unable to identify a replacement charterer, the charteree must retain:
- 50% of the charter fee for termination up to one month before the charter starting date.
- 100% of the charter fee for termination in less than one month.
If the cancellation is due to objective circumstances (death of a family member, serious injury, war, or other), the agreed deposit will not be refunded, but the charteree will make the boat available to the charterer for another free period of time within the same season.
COMPLAINTS:
Complaints will only be accepted in writing upon the return of the boat and must be signed by the person in charge on behalf of the Charteree.
ARBITRAGE:
In the event of a disagreement arising from this Contract that cannot be settled amicably, the parties agree to submit to the jurisdiction of the court in the charteree's domicile.
Damage Deposit is fully refunded to you in 72 hours of your checkout, subject to any breakage/damage claims by the Operator/Owner.
