KUMBOR-1 WEEK CHARTER
Kumbor, a lovely coastal village in Montenegro, is a hidden gem for sailors looking for peace and beauty along the Adriatic coast. Kumbor, located on the magnificent Bay of Kotor, provides a tranquil escape with its stunning landscapes and peaceful attitude. When you arrive at Kumbor, you'll be met with crystal-clear waters and a backdrop of lush, green hills. With its modest architecture and friendly residents, the village emanates a tranquil charm. The coastline of Kumbor is lined with little beaches and coves ideal for swimming and sunbathing in the Mediterranean sun.

Day 1 (SATURDAY):
• Arrive at Lazure marina and hotel complex. Welcome on your sailing yacht and check-in procedure.
• Relaxation day with options for drinks, swimming, and spa. Dinner at the Leut konoba or in Herceg Novi's charming old town.
Day 2 (SUNDAY):
• Sail from Herceg Novi Bay towards Luštica peninsula and Trašte bay. Anchorages in coves Žanjic and Mirišta.
• Recommended anchorage: Mirišta with dinner at Restaurant Mirišta.
Day 3 (MONDAY):
• Explore anchorages in Budva Riviera, including Trsteno and Jaz. Optional mooring near Sveti Nikola island.
• Visit the famous Sveti Stefan island. Overnight at Dukley marina in Budva.
Day 4 (TUESDAY):
• Sail towards Tivat bay. Best anchorage: Island Stradioti.
• Dining option at Vino Santo or sail to marina Porto Montenegro.
Day 5 (WEDNESDAY):
• Navigate through the Verige strait towards Risan or Kotor bay.

EXTRAS:
• If you want extra stuff like an auxiliary engine, one-way options, or transfers, ask for them before confirming your booking.
• You can also request these extras after booking, and we'll try to make it happen if possible.
• We're not obligated to provide extras after booking.
• Make sure to confirm all extras in writing at least 10 days before your charter starts.
BOOKING:
• The booking intention is confirmed when the Client submits an advance payment.
• The Company will confirm the booking when the full advance payment amount is received in its account, and a Booking Confirmation is issued to the Client or the Agency.
PAYMENT:
• A 50% advance payment is required at the time of yacht reservation.
• The remaining 50% of the balance must be settled no later than 1 month before the yacht charter date.
• All payments must be made according to the payment instructions provided in the Pro-forma Invoice sent by the Company to either the Client or the Agency.
• The Vessel can be taken over only after the complete amount for yacht charter and all contracted extra services have been fully settled.
• If either the advance payment or balance payment has not been fully settled by the deadlines mentioned above, the Company shall be entitled to cancel the Vessel's booking without any refunds to the Client.
SKIPPER:
The company will provide a professional skipper who will follow the client's instructions for managing and operating the vessel. However, if there's a safety risk to the vessel, people on board, or others, the skipper will take control to ensure safety and prevent harm, following the company's instructions.
SKIPPER RESPONSIBILITIES:
• The skipper will ensure safety equipment and yacht functionality are understood.
• The skipper navigates, moors, and maintains the yacht but doesn't handle tasks like cooking.
• The skipper shares local knowledge and acts as a guide.
• They sail up to 8 hours a day, avoiding night sailing.
• The skipper decides when to use sails based on weather.
• The skipper is responsible for mooring, refilling, and port procedures (costs covered by the client).
• They decide where to spend the night based on the weather.
• The skipper needs food and a sleeping cabin provided by the client.
• The skipper is responsible for damage they can foresee, the client is liable for other damage.
• The client must follow safety instructions and assist the skipper when needed.
• If the skipper doesn't fulfill their duties, the client can request a replacement through the company.
TAKEOVER OF THE VESSEL:
• The boat can be picked up between 5 p.m. and 8 p.m. If you don't pick it up within 24 hours without notice, the company can cancel the contract without compensation.
• If the company can't provide the reserved boat on time, they have 24 hours to offer a similar or better boat. If they can't, you can cancel the contract and get a refund.
• If you wait for a substitute boat beyond the agreed 24 hours, you can get a refund for the days you couldn't use the boat.
• The company provides a technically sound, well-equipped, clean, and fueled boat.
• Check the boat's condition and equipment when you pick it up. Raise any concerns before your journey starts.
• Hidden defects or damage not known to the company at handover, as well as damage after return, don't qualify for rent discounts or compensation.
CLIENT RESPONSIBILITIES:
• Crew List Submission: The Client needs to send a complete crew list to us, and this must be done no later than 10 days before the charter starts.
• Client as Main Contracting Party: The Client is the primary person responsible for the charter, and they are also responsible for all the other guests who will be on board.
• Arrival Information: To make the check-in process smooth, it's a good idea to let us know your estimated time of arrival at least 10 days before the charter begins.
• Transfers: If you've booked a transfer, like transportation from the airport, you must provide detailed arrival and departure information at least 10 days in advance.
• Document Accuracy: The Client is responsible for making sure that all the information on the crew list is accurate. This includes checking that passports, visas, licenses, and other identification documents are valid.
• Sailing License: The Client must understand that the sailing license is a crucial document on board, and they are legally responsible for ensuring that it's accurate and trustworthy.
CANCELLATION POLICY:
# Cancellation by client:
If the Client requires canceling the scheduled yacht hire for whatever reason, the Client must quickly notify us through email of the cancellation. The cancellation fee you'll pay may vary depending on time you make it:
• If you cancel up to 30 calendar days before the start of your accommodation, you may be charged up to 50% of the full accommodation rate.
• If you cancel less than 30 calendar days before the start of your accommodation, you may be charged up to 100% of the full accommodation rate.
• However, if we or you manage to find another client for the same period you canceled, you may not be charged at all.
The cancellation fees are subject to change based on when we receive your written cancellation notice. In rare circumstances, such as unanticipated emergencies (such as a death in the family, a major sudden illness, or a significant accident), we might let you use the money you've already paid as a down payment for a subsequent reservation made within a year. There will be a 100% cancellation fee and no refund if you don't show up for check-in (non-show up) or depart the vessel before the scheduled check-out time (early abandonment).
# Cancellation by company:
You will have two choices if the company must cancel your reservation for whatever reason:
• They can reserve another boat for you, either from their own fleet or one identical in size and features if possible. If the new boat is less expensive than the old one, they will refund the difference based on the current price lists of both boats, utilizing the same discounts you received for the initial booking. The new boat is subject to the same booking conditions.
• You have the option of receiving a complete refund of all money paid.
SECURITY DEPOSIT:
• Security Deposit: Before you start your yacht trip, you have to give the Company some money as a deposit. This can be in cash or paid with a credit card they accept.
• Getting Deposit Back: After your trip, they'll give all the deposit money back unless something goes wrong, like damage to the boat or missing stuff, or if you didn't follow the rules.
• How Much They Keep: If there's a big problem, they keep everything. For smaller issues, they keep some money for repairs and costs, plus a little extra for handling. If the boat can't be used for the next trip because of damage, they keep everything to cover their expenses.
• Skipper's Costs: If you hire a professional skipper from them, the deposit can't be used to pay for their mistakes.
• Serious Problems: If you do something really bad, like sail drunk, sail alone when you shouldn't, or break important rules, you'll have to pay for all the expenses, not just the deposit. You need to pay these extra costs within a month after your trip ends.
• Lost Equipment: If you lose stuff like a dinghy or engine, you have to pay for it within a week after your trip.
INSURANCE:
• Accepting Risks: When you go on a yacht trip, you're agreeing to take on all the possible problems and dangers that can happen. This includes any harm that might come to you or your crew.
• Your Responsibility: You have to be careful and use the yacht safely. If something bad happens, like accidents, injuries, or things getting damaged or lost (during or after your trip), it's your responsibility, and the Company isn't to blame.
• Insurance: The boats have insurance for damage to the boat itself and for harm to other people or things. But if the sails get damaged, you have to pay for it. Insurance won't cover your personal stuff or stuff you bring on the boat, and it won't pay for things you break on purpose or because you weren't careful.
• Get Travel and Health Insurance: It's a smart idea for you and your crew to buy travel and health insurance when you book your trip. This way, you're protected in case something goes wrong while you're on your adventure.
CHECK-IN:
• Getting the Boat: When you get the yacht, you need to provide some paperwork and IDs for everyone on board. You'll also check the boat's condition and what's on it with a Company person, and you'll sign to say it's all good. If you say it's okay, you can't later complain about things that were broken or missing but not noticed at the time.
• Previous Damage: If some parts of the boat are messed up from previous trips, but it doesn't make things unsafe, you can't cancel or get a lower price. It's not the Company's fault, it's from what a previous customer did.
• Returning the Boat: When you give the boat back, it should have a full tank of fuel and water, just like when you got it.
• Proving You Can Sail: You might have to show that you know how to sail the boat. If you're not good enough, the Company might hire a skipper for you, and you have to pay for that. If you say no to the skipper, your contract ends, and you don't get your money back.
CHECK-OUT:
• When you give the boat back, they'll check if the fuel tank is full. If it's not, you have to pay for the fuel you used, plus a service fee.
• If there's any damage to the boat, you'll have to pay for that, as explained in the "Security Deposit" part.
• If you return the boat to a different place than you agreed, you have to pay for all the transport costs, including expenses for the next person who rents the boat, and a penalty fee of 300 EUR.
• If you're late in returning the boat, you'll be fined. Delays longer than 3 hours get a big fine, plus extra costs because of the delay. Bad weather isn't a good excuse because you need to be close to where you started for the last 48 hours.
• If you want to extend your trip, tell the Company right away. They'll check if it's okay, and if it is, they'll do the paperwork for the extra days once you've paid.
DAMAGES DURING CHARTER:
• If something happens to the yacht during your trip, and they fix it within a day after you tell them, you can't ask for any money back.
• But if it takes more than a day to fix, and it was a big problem that kept you from using the yacht, you can ask for some money back for that time.
• You'll only get this refund if the problem was the Company's fault, like if they didn't take good care of the yacht.
• If the problem is so bad that the yacht has to go back to the base for repairs, they'll try to fix it in time for the next customers. They'll only give you money back for the days you couldn't use the yacht if it was their fault.
• If something really serious happens, like big damage, the engine breaks, or someone gets hurt, you have to tell the Company right away and get official reports from other authorities. If you don't tell them and there are no official records, they'll think it happened because you weren't careful, and you'll have to pay for it.
LIABILITIES OF CHARTER COMPANY:
• You'll get a clean yacht with a full tank of fuel and water.
• They'll follow standard check-in and check-out procedures.
• If you have special requests, they'll try to help, but they don't have to, and you can't ask for money if they can't do it all.
• If the yacht isn't ready within 4 hours of your agreed start time, you can ask for some money back based on the delay.
• If it's over 24 hours late, you can ask for a similar-sized replacement yacht. If they can't find one, you can get money back for the days you missed. But they won't pay more than what you paid.
• They're not responsible for delays due to big events like natural disasters, wars, strikes, or bad weather.
LIABILITIES OF CLIENT:
• You need to know how to sail or get a skipper from the Company.
• If it's a bareboat charter, you must have the right licenses.
• Don't let someone else use the yacht.
• No making money from the yacht, like carrying passengers for pay.
• Have the exact number of people you said on your crew list.
• Keep the crew list and ship documents with you during the charter.
• Tell the Company about any crew changes.
• Follow the rules of the country you're in.
• Don't race or join regattas without the Company's permission.
• Do safety checks while cruising.
• If you need towing, agree on payment first.
• Take care of the yacht and avoid damage or towing.
• Don't sail in strong winds or if the port authorities say no.
• Be careful with the yacht's parts and sails, considering the weather.
• Plan your route so you're close to the check-out base two days before the end.
• Don't sail at night or alone without permission.
• Tell the base manager if there's bad weather so they don't search for you.
• No drinking or drugs while operating the yacht.
• Keep quiet in marinas and respect others' rest.
• No fishing or underwater activities without the right licenses.
• Don't bring pets without written permission from the Company.
Damage Deposit is fully refunded to you in 72 hours of your checkout, subject to any breakage/damage claims by the Operator/Owner.
